Terms and conditions of shelter.shop

§1 General provisions
1 The Rules and Regulations set out the principles for the use of the online shop www.shelter.shop, hereinafter referred to as the "Online Shop", the manner of purchasing products found on Our website, as well as the procedure for complaints.

2. The User using the Online Shop confirms that he/she has read the content of these Terms and Conditions and accepts all of its provisions and undertakes to comply with them.

3. The online shop is operated by Shelter.pl Sp. z o.o. with registered office in Wrocław, ul. Muchoborska 6, 54-424 Wrocław; entered in the Register of Entrepreneurs of the National Court Register under KRS number 0001015369 by the District Court for Wrocław Fabryczna in Wrocław, 6th Commercial Division of the National Court Register; NIP: 8992950624; REGON: 524343237.

4. These Terms and Conditions are made available free of charge via the website of the Online Shop at: www.shelter.shop, in a form that allows it to be downloaded, saved and printed.

§2 Definitions

1) User/Purchaser/Customer - a natural person over 13 years of age, a legal person or an organisational unit without legal personality, to which separate regulations grant legal capacity, who uses the services of the Internet Store.

2. Consumer - a user who is a natural person and who makes a legal transaction in the Online Shop which is not directly related to his/her economic or professional activity.

3. Product/good - a movable item offered by the Seller in the Online Shop for sale.

4. Sales contract - a distance sales contract concluded between the Buyer and the Seller under the terms of these Terms and Conditions.

5. Merchant/service provider - Shelter.pl Sp. z o.o. with registered office in Wrocław, ul. Muchoborska 6, 54-424 Wrocław; entered into the Register of Entrepreneurs of the National Court Register under KRS no. 0001015369 by the District Court for Wrocław Fabryczna in Wrocław, 6th Commercial Division of the National Court Register; NIP: 8992950624; REGON: 524343237.

6. Rules and Regulations - means these Rules and Regulations.

7. Working days - weekdays from Monday to Friday excluding Saturdays and public holidays.

8. Registration - a set of actions consisting in proper completion by the User of an on-line form on the website of the Online Shop.

9 Delivery - the actual act of delivering to the Buyer by the Seller, through the Supplier, the Goods specified in the order.

10. Supplier - the company with which the Seller cooperates in making the Delivery of Goods.

11. Courier - the entity or organisation whose task it is to deliver the goods ordered by the users to the delivery address indicated by them.

12. Store Website - the website under which the Seller operates the Online Store, operating under the domain www.shelter.shop.

13. Registration Form - a form available in the Online Shop which enables the creation of an Account.

14. Order Form - a form available in the Online Shop which enables placing an order, in particular by adding Products to an electronic shopping cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.

15. Account - Electronic Service, a set of resources in the Service Provider's ICT system, marked with an individual login (name) and password provided by the Customer, in which the data provided by the Customer and information about orders placed by him/her in the Online Shop are stored.

16 Electronic Service - a service provided electronically by the Service Provider to the Customer via the Online Shop.

§3 Technical requirements

1.  To use the Online Shop correctly, you need a device with Internet access and a web browser that supports JavaScript and cookies.

2. To place an order in the Online Shop, in addition to the requirements set out in para. 1, it is also necessary to have an active e-mail account.

§4 Registration and user account

1. Registration and creation of an Account by the Client in the Online Shop is free of charge and voluntary. The service is provided by the Service Provider on a continuous basis from the moment the Client activates the Account.

2. Registration is not necessary to place an order in the Online Shop.

3. Registration and the creation of an Account by the Customer shall take place by correctly completing and submitting to the Service Provider the Registration Form, which can be found on the Shop's Website.

4. The Client is obliged to provide true data in the Registration Form. In the event that the Client provides false data, the Service Provider has the right to refuse the Client's Registration or, in the event that the data is found to be false, after the Registration has been completed, the right to block the Client's Account and unregister the Client. The Service Provider shall inform the Client electronically of the fact and reasons for refusal of his/her Registration or blocking of the Account.

5. After submitting the completed Registration Form, the Client will receive from the Service Provider a confirmation of the Registration and the creation of the Account at the e-mail address indicated by the Client in the Registration Form.

6. If, after the User has registered and created an Account, his/her data changes, the User is obliged to update his/her personal data. The change of data takes place by completing and submitting an update form after logging in to the User's account.

7. The Service Recipient may at any time, without incurring any costs, resign from having an Account in the Online Shop. In order to resign from having an Account, one must send his/her resignation to the Service Provider at the e-mail address: hello@shelter.shop, which will result in the immediate deletion of the Client's account by the Service Provider.

§5 Procurement

1. The user can place orders in the Online Shop 7 days a week, 24 hours a day.

2. To place an order, the User selects the Products in the Online Shop and places them in the shopping cart.

3. Until payment is made, the User can view the contents of his/her basket and control the value of the order.

4. You may cancel your order at any time by removing the Products from your basket.

5. In order to place an order, the User provides all the necessary information available in the Order Form (including address and method of delivery, form of payment), which is sent to the Seller, and then transfers the money to the bank account indicated by the Seller. Each time before the order is finalised, the User is informed of the total price for the selected goods and delivery. In addition, the User is informed of all additional costs he or she is obliged to pay in connection with the Sales Contract.

6. the Seller confirms the acceptance of the User's Order by sending an e-mail message to the e-mail address indicated by the User, and when the order is approved, the Seller also sends information about the acceptance of the order for execution.

7. Placing an order for products in the Online Shop is tantamount to concluding a Sales Agreement between the Buyer and the Seller.

8. The buyer may cancel his order within 24 hours of placing it, provided that the Seller has not proceeded with the order.

9. The seller shall proceed with the order after the payment for the ordered goods has been made.

10. The seller shall process orders on working days.

§6 Payments

1. The prices indicated in the Online Shop are gross prices. Other costs related to the sales contract will be given to the User when placing an order via the Order Form.

2. The user can choose from the following forms of payment:

- electronic payment, payment by credit card, Paypal and Revolut payment

3. The user expressly authorises the seller to issue electronic invoices.

§7 Delivery

1. The delivery of the Goods available in the Online Shop is carried out in the territory of the European Union countries.

2. The seller is obliged to deliver the Goods without defects.

3. There is a charge for the delivery of the Products available in the Online Shop. All costs associated with the delivery of the Products will be indicated to the User when placing an order via the Order Form.

4. The estimated delivery date will be indicated by the Seller each time an order is finalized.

5. The ordered goods are delivered to the User via the Supplier to the address indicated by the User in the Order Form. On the day the order is dispatched, the Seller sends information about the shipment to the User's e-mail address.

6 Delivery is made by GLS or DHL courier companies.

7. If the Seller does not find the Buyer at the Delivery address provided by the Buyer, the Seller will leave a postcard or attempt to contact the Buyer by telephone to arrange a time when the Buyer will be available at the address provided. In the event that the ordered Goods are returned to the Seller by the Supplier, the Seller will contact the Buyer by email or telephone, re-arranging with the Buyer the date and cost of Delivery.

§8 Collection of opinions about products and the Shop

1. The shop has the right to ask the customer to provide feedback on portals other than the shop's website after an order has been fulfilled.

§9 Complaints

1. In the event that the Goods delivered have defects, the Buyer may make a claim for defective Goods on the basis of a regulated warranty or guarantee.

2. A complaint relating to the Goods or the performance of the Sales Contract may be made by the Buyer using the complaint form or e-mail which can be found on the dedicated Complaints page.

3. The seller will respond to the complaint within 14 working days of its submission.

§10 Guarantee

1. Goods sold by the Seller are covered by a guarantee provided by the Goods Manufacturer.

2. Information on the existence and content of the guarantee is presented each time on the Shop's Website.

§11 Withdrawal from the sales contract

1. A Buyer who is a Consumer who has entered into a Sales Contract with the Seller has the right to withdraw from it within 14 days without giving any reason.

2. The period for withdrawal from the Sales Contract shall begin from the moment the Goods take possession of the Consumer.

3. The declaration of withdrawal shall be submitted in writing to the Seller's address, electronically to the Seller's e-mail address or via the electronic form available at www.shelter.shop.

4. In the event of withdrawal from a distance contract, the contract shall be deemed not to have been concluded.

5. The Seller shall, within 14 working days from the date of receipt of the declaration of withdrawal, refund to the Consumer all payments made by the Consumer, including the cost of delivery of the Product. The Seller shall refund the payment using the same payment method used by the Consumer when making the purchase. The Seller may withhold reimbursement of payments received from the Consumer until it has received the Goods back or the Consumer has provided evidence of having sent back the Goods, whichever event occurs first.

6. In the event that the Consumer has chosen other than the cheapest method of Delivery, the Seller shall not be obliged to reimburse the additional costs incurred by the Consumer.

7. The Consumer is obliged to return the product to the Seller within 14 working days from the day on which he or she withdrew from the Sales Agreement. The Consumer shall return the product to the Seller's address.

8. The consumer shall be liable for any diminution in the value of the Goods resulting from their use beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

9. The consumer shall bear the direct costs of returning the Product.

§12 Termination of the contract for the provision of electronic services

1. Both the Customer and the Service Provider may terminate the contract for the provision of services by electronic means at any time and without giving reasons, subject to the preservation of the rights acquired by the other party before the termination of the aforementioned contract and the provisions below.

2. A Client who has registered terminates the contract for the provision of services by electronic means by sending to the Service Provider an appropriate declaration of intent, using any means of remote communication that enables the Service Provider to take note of the Client's declaration of intent.

3. The Service Provider shall terminate the contract for the provision of services by electronic means by sending a relevant declaration of intent to the Client at the e-mail address provided by the Client during Registration.

§13 Final provisions

1. These Regulations shall come into force on 17 April 2023.

2. The Seller reserves the right to amend the Terms and Conditions. All orders accepted by the Seller for fulfilment before the effective date of the new Terms and Conditions are fulfilled on the basis of the Terms and Conditions that were in force on the day the User placed the order.

3. Changes to the Terms and Conditions come into force within 7 days from the date of publication of the change on the Store's Website. The Seller will inform the User 7 days before the new Terms and Conditions come into force about the change of the Terms and Conditions via User's e-mail, sending him the text of the changed Terms and Conditions. If the User does not accept the content of the amended Terms and Conditions, he/she is obliged to notify the Seller, which results in termination of the contract in accordance with the provisions of §11 of the Terms and Conditions.
